These Terms and Conditions govern use of LaunchReply’s automated lead response services. By engaging LaunchReply as a service provider, client businesses agree to these terms.

1. Service Description

LaunchReply provides automated SMS and email response services for local small businesses. The program name is LaunchReply. The service sends automated notifications to individuals who submit inquiry forms on client business websites. Message frequency varies based on the volume of inquiries received through the client’s contact forms.

2. SMS Program Terms

LaunchReply sends SMS messages on behalf of client businesses to individuals who have opted in via a web form submission. The following terms apply to all SMS communications:

• Program name: LaunchReply (on behalf of [Client Business Name])
• Message frequency: Varies based on inquiry volume
• Message and data rates may apply
• To opt out: Reply STOP to any message
• For help: Reply HELP or contact contact@launch-reply.com
• Support phone: Available through client business contact information

3. Opt-In and Consent

SMS messages are sent only to individuals who have explicitly consented by submitting a contact form that includes clear opt-in language. Client businesses are responsible for ensuring their contact forms include required opt-in disclosure language before deploying LaunchReply services.

4. Opt-Out

Recipients may opt out of SMS messages at any time by replying STOP to any message. Upon receipt of a STOP message, no further SMS messages will be sent to that number. This opt-out applies to the specific sending number associated with the client business campaign.

5. Client Responsibilities

Client businesses are responsible for:

• Ensuring opt-in consent language is present on all contact forms prior to service activation
• Maintaining accurate contact information and business details
• Complying with applicable federal, state, and local laws regarding electronic communications
• Not using the service to send messages to individuals who have not opted in

6. Prohibited Use

LaunchReply services may not be used to send spam, unsolicited marketing messages, or communications to individuals who have not opted in. Any use that violates TCPA, CAN-SPAM, or carrier guidelines is strictly prohibited and will result in immediate service termination.

7. Limitation of Liability

LaunchReply is not liable for message delivery failures caused by carrier filtering, network outages, or incorrect contact information provided by end users. Service is provided on an as-is basis. LaunchReply’s total liability to any client shall not exceed the fees paid in the prior 30 days.

8. Modifications

LaunchReply may update these terms at any time. Continued use of the service after notice of changes constitutes acceptance. We will notify active clients of material changes by email.
